•A Manhattan jury awarded $2.33 million to a man who lost his leg after drunkenly stumbling onto the path of an oncoming subway train. The man fell on New York subway tracks, was hit by a train and had his leg severed in 2006. The man, 25, landed in the subway tracks after a late night watching a hockey game at a bar with friends April 23, 2006. A downtown N train ran over him, severing his right leg. According to the man's lawyer, NYC Transit bore primary responsibility for the accident because the subway driver had time to stop the train but did not. The mans drunkenness did not excuse the driver, who said in a court deposition that he mistook the man for an inert object. "They don't get a free pass as to why the person was on the tracks. They are trained to be able to look out for people on the tracks ... and people are known to be intoxicated by night," the lawyer said. The man's blood-alcohol level at the time of the accident was .18, according to his lawyer, more than twice the legal limit had he been behind the wheel of a car. The jury ruled Tuesday that the man was 35 percent responsible for the accident, so his monetary compensation was also reduced by 35 percent -- from $3,594,943 to $2,336,713.

•A Federal jury has awarded $19.8 million to a 29-year-old man who was paralyzed in a motorcycle accident in 1988.

•$23.4 million to a NY teenager who suffered a serious debilitating brain injury in a car accident when a driver ran a red light and slammed into his family’s car, leaving the youth in a coma.

•A Manhattan woman whose husband and infant son were killed in a 1975 crash after a van jumped a divider on Route 4 in Teaneck has won at least $2 million in damages in a settlement with the state and the driver of the van. The agreement, announced yesterday in Hackensack, comes exactly one year after a precedent-setting ruling by a Superior Court jury. The ruling found the state Department of Transportation negligent in its repair work on a section of Route 4. Repeated resurfacing blamed Repeated resurfacing of the highway lowered the height of an 18-inch concrete road divider, a condition that contributed to four accidents that killed four persons and left five children orphaned. Once the liability question was resolved, each accident was assigned separately to new juries to determine the amounts of damages. Yesterday’s settlement was the first to be reached.

•Authorities say one child was killed and two other children were seriously injured after a van mounted a sidewalk and struck them in New York City's Chinatown. Police say they were among a group of 14 children standing or walking in front of a Cathay Bank branch on East Broadway at 11:31 a.m. Thursday. A white van could be seen on the sidewalk. Authorities say one child is in critical condition and another is serious but stable. Another two or three children appear to have minor injuries. They all have been taken to New York Downtown Hospital. The scene of the accident, near Market Street, is clogged with emergency vehicles, including ambulances from various area hospitals. It is a very busy commercial street with apartments above some businesses. An elevated subway crosses East Broadway and runs parallel to Market Street.

•A jury in Federal District Court in Brooklyn awarded merchant seaman $6.5 million for injuries suffered in a plane crash that left him a paraplegic.

•An elderly woman left partly paralyzed because Queens hospital workers waited two hours to give her emergency care for a fractured skull has been awarded $10.7 million. 

•Manhattan woman whose husband and baby were killed in a crash after a van jumped a divider on Route 4 in Teaneck awarded $2 million in damages in a settlement with New York state and the negligent driver of the van.

•A jury in Queens awarded a Manhattan couple $49 million for a medical malpractice verdict against Hospital for the botched birth of their daughter. Their daughter suffered injuries during her birth causing brain damage and cerebral palsy.

•$6 million awarded to the children of a woman who died in NY Hospital after undergoing a Caesarean section. The mom dies several days after the operation. $4.5 million for wrongful death and $1.5 million for pain and suffering.The jury found the hospital and the obstetrician liable for the moms death.

•$14.5 million to the family of a Long Island woman who died of cervical cancer due to medical malpractice. Women dies after a medical laboratory failed to detect her cancer on a pap smear. Victims family sued her gynecologist, and the laboratory, in Massapequa. The jury found the lab responsible for womens death.
