MTA Train Accident Results in Amputation

An MTA train accident results in the partial loss of a leg for a signal helper and flagger according to the New York Post. The MTA worker, 26-year-old Andre Downes, was struck by a northbound express train while he was investigating a signal failure. The accident occurred near the 8th Street-NYU station early last year.

The MTA accident resulted in the partial amputation of the employee’s left leg and “multiple fractures in his right leg.” He was hospitalized as a result of the incident and is suing the city for negligence. The worker was reportedly wearing a reflective vest at the time of the accident. The operator of the train, however, was unable to stop the train before it struck Downes.

What to Do If You Are Involved in an MTA Accident

If you are involved in an MTA accident in New York City you need to act quickly as you may only have a limited amount of time to recover damages.

First and foremost, you need to seek medical attention. Train accidents generally result in severe, potentially life-threatening injuries. Failing to seek medical treatment could directly impact your recovery and result in serious complications.

Once you are able, you should contact an experienced MTA accident lawyer. A lawyer can help you determine whether you have a valid personal injury claim and how to proceed with your case. In some instances, you may need to make a legal request for evidence such as surveillance video and safety logs to prove your case.

Why You Should Hire an Attorney

Hiring an attorney can help ensure that you receive the maximum recovery allowed based on the circumstances of your case. Without the help of a qualified attorney, you may end up settling your case for less than it is worth. An attorney will work tirelessly to get you a full and fair settlement or take your case to trial to get the results you deserve.
