Crash Victim Dragged for Blocks

According to the Brooklyn Paper, a man has been arrested in Bay Ridge after reportedly leaving the scene of an accident and dragging the victim for blocks. The New York Police Department notes that the 30-year-old was driving a 2015 Lincoln SUV when he allegedly hit a person late last month. The man left the scene of the accident without exchanging information.

The 33-year-old victim then attempted to chase down the driver, holding on to his vehicle. The hit-and-run driver, however, kept going, dragging the person for blocks. It is alleged that the driver also ran over the victim in his attempt to flee the scene. The driver was eventually apprehended by local law enforcement. He was charged with multiple counts, including reckless endangerment, assault, and leaving the scene of an accident.

Do You Have to Stop After an Accident?

New York law requires that motorists stop after a crash, regardless of the level of damage. A motorist could be charged with a crime if they leave the scene of an accident where someone was killed or injured.

Even if the collision only resulted in property damage, a motorist is still required to exchange information with any other involved parties. If a person was injured or killed as a result of the accident, you must contact the police.

Obtaining Compensation After a Hit and Run Accident

If a driver leaves the scene of an accident, it may make it more difficult to obtain compensation from them if you are seriously injured. However, you still have ways to ensure that you receive the recovery you deserve after a crash. It is important to contact an attorney as early in the process as possible to ensure that you understand all of your legal options.

New York is a no-fault state, meaning that you will likely start by filing a claim for damages through your own insurance regardless of who caused the accident. If your injuries are extensive (serious), then you may exceed the no-fault limits. Depending on the situation, you might be able to use your uninsured motorist coverage or seek compensation through the Motor Vehicle Accident Indemnification Corporation (MVAIC).
