Are a Hit and Run Accident and Leaving the Scene the Same Thing?

Despite being used interchangeably, a hit-and-run accident and leaving the scene of an accident can actually refer to two different things. 

A hit-and-run occurs when a person does not stop after a crash or collision. New York State law requires that motorists stop if they are involved in an accident, regardless of whether anyone is hurt or the amount of property damage. You can be charged with a criminal offense for failing to stop after an accident.

In addition to stopping after an accident, you need to exchange information with the other people involved in the crash. Generally, you must provide your name, address, insurance information, and vehicle registration number. Failure to exchange information could be seen as leaving the scene of an accident, even if you initially stopped.

Obtaining Compensation If Someone Leaves the Scene of an Accident

New York follows no-fault insurance laws, meaning that individuals who are injured in an accident generally pursue a claim for compensation through their own insurance company regardless of fault. If the other driver leaves the scene of the accident without exchanging information, you may still file a claim through your own insurance company.

If you do not have insurance and were involved in a hit-and-run, you may be able to obtain compensation through the Motor Vehicle Accident Indemnification Corporation (MVAIC).
