Who Must Wear a Seat Belt in New York?

As of November 1, 2020, the New York Taxi & Limousine Commission states that every driver and passenger is required to buckle up. It doesn’t matter how old you are or where in the vehicle you are sitting.

Adult drivers and passengers will be issued tickets. The parent present or the driver of the vehicle will receive the ticket if the offender is 16 or younger. Ultimately, cab and limo drivers are responsible for ensuring that everyone knows they should buckle up, but adults are ultimately responsible for themselves.

Common Injuries While Wearing a Seatbelt

There are many potentially serious injuries that can occur in a car accident even if you are wearing your seat belt. These include:

  • Whiplash
  • Head injuries
  • Knee injuries

In addition, the National Library of Medicine reports that seat belts themselves can cause injury. These include:

  • Hip injuries
  • Shoulder injuries
  • Bruised or broken ribs
  • Bowel injuries
  • Liver lacerations
  • Splien lacerations
  • Pancreas lacerations
  • Kidney injuries
  • Lumbar spine fractures

Some of these injuries can occur whether or not you are wearing a seat belt. It is very difficult to determine the exact cause and extent injuries would have if a seat belt is worn versus not being worn. It can also be difficult to determine whether or not a person was wearing a seat belt at the time of a car accident.
