Who Is Responsible for a Pothole-Related Accident?

Road defects such as potholes can cause serious damage to an unsuspecting driver. Potholes create a dangerous condition for motorists. Potholes have been known to cause collisions, tire damage, alignment issues, and even significant injuries. Most drivers do not realize that the city or another government entity may be responsible for your damages.

Can I Sue for Damages If I Am Injured Due to a Pothole?

In general, government entities, such as a city or county, are responsible for keeping their streets in a reasonably safe condition.

In New York City, in order to be held liable, the city must receive notice of the dangerous condition. Administrative Code Section 7-201(c) requires that the commissioner of transportation or an authorized person or department receive written notice of the defect or the unsafe condition. Notice may also be given if someone was previously injured or suffered property damage as a result of the hazard.

Additionally, it must be shown that there was a failure to repair or remove the condition within 15 days of receipt of the notice. If these requirements are satisfied, you might be entitled to compensation for your damages. The only way to ensure that you receive the money you deserve is by contacting an attorney.

How to Pursue Compensation After a Pothole Accident

If you suffer any damages related to a pothole accident, you should contact an attorney as soon as possible. An attorney can help determine whether you have a valid claim for damages.

Pothole accidents may cause:

  • Damage to your vehicle
  • Physical injuries
  • Damage to personal property
  • Lost wages
  • Loss of future earning capacity
  • Pain and suffering

In order to pursue compensation against the city, you must first show that the city received notice of the hazard and failed to remedy it within 15 days. It can be challenging to prove that the city knew of the condition without the help of a qualified attorney.
