Who Is Responsible for a Pothole-Related Accident?

In New York City, in order to be held liable, the city must receive notice of the dangerous condition. Administrative Code Section 7-201(c) requires that the commissioner of transportation or an authorized person or department receive written notice of the defect or the unsafe condition. Notice may also be given if someone was previously injured or suffered property damage as a result of the hazard. 

Additionally, it must be shown that there was a failure to repair or remove the condition within 15 days of receipt of the notice.
