New York court awards/settlements:

•A woman delivered a baby who sustained hypoxic ischemic encephalopathy during delivery. The child, now 7 years old, has cerebral palsy, cortical blindness, seizure disorder, scoliosis, multiple contractures throughout the body, and spasticity. The child is incapable of participating in any activities of daily life. In suing on behalf of the child, the plaintiff claimed the hospital nursing staff failed to inform the physician of rising maternal blood pressure and uterine hyperstimulation during labor; failed to decrease oxytocin in the presence of that hyperstimulation; and failed to investigate a lack of urine output for 7.5 hours before delivery. The plaintiff also claimed the physician failed to take action on those developments; failed to recognize nonreassuring fetal heart tones; failed to order a cesarean section because of the distress signs; improperly removed the intrauterine pressure catheter; and improperly ordered a vaginal delivery. The physician denied being informed of adverse conditions and claimed her decision to proceed with vaginal delivery under the circumstances was appropriate. The jury awarded the plaintiff $32.036 million.

•A jury has awarded $43.9 million to a 10-year-old Brooklyn boy whose brain was damaged at birth, a condition his lawyers argued was made worse by the mistakes of a hospital staff. The verdict late Friday in State Supreme Court in Brooklyn capped a two-week trial. The lawyer for the boy, argued that the boy was was injured when he was deprived of oxygen by the staff at Kings County Hospital in Brooklyn on Aug. 11, 1987. The boy's mother had entered the hospital in the 30th week of her pregnancy after membranes supporting the baby broke prematurely. ''The infant should have been rescued by emergency Caesarean section, instead, when every minute counted, the mother was left to labor for an additional half-hour, sucking the breath from Naquan before the emergency surgery was finally ordered.''

•A former Franklin County construction worker has been awarded $9.6 million for a near-fatal accident that robbed him of his eyesight.

•A New York jury awarded $20 million to a construction worker who fell through a ductwork hole while working at a Federal courthouse in Islip. The worker, suffered severe spinal injuries falling several feet after the ladder he was descending broke through plywood covering the hole.

•A Borough Park man has been awarded $4.6 million for catastrophic injuries suffered when a young police officer ran him over, an incident in which the officer admitted under oath that he initially lied about what happened, according to the man's lawyer and court papers. The wife was not hurt, but her husband, then 57, fractured his leg and shoulder and suffered head wounds and brain damage when he was hit by a patrol car driven by an Officer says the Framowitzes' lawyer.
